Terms of Use

These Terms of Use govern your access to and use of the EBX Control Center at portal.ebx.energy and the EBX API, including its documentation at docs.ebx.energy (together, the "Services"), operated by EBX Technologies GmbH, Leopoldstraße 20, 80802 Munich, Germany, registered with the commercial register of the Local Court of Munich under HRB 308865 ("EBX", "we", "us").
By accessing the Services you accept these Terms. If you do not accept them, do not use the Services.
1. Relationship to customer agreements
These Terms govern use of the Services only. The services EBX provides to its customers are governed by the individual agreement concluded between EBX and that customer. Where these Terms and such an agreement differ, the individual agreement prevails.
2. Control Center and API access
Access to the EBX Control Center and to the EBX API is granted to customers and partners of EBX, and to the individual users and systems they nominate, under their agreement with EBX. Access is not available without such an agreement.
If you hold access credentials or API keys:
you use them only within the scope of the agreement under which they were issued
you keep them confidential, do not share them with any other person, and do not embed them where third parties can retrieve them
you notify EBX without undue delay at terms@ebx.energy if you become aware that credentials have been lost, disclosed or used without authorisation
you are responsible for all activity carried out under your credentials, including activity by systems you connect
EBX may suspend or withdraw access where it has reason to believe credentials have been compromised, where these Terms are breached, where access threatens the availability or integrity of the Services, or where the underlying agreement ends.
3. Use of the API
The API is provided for use in connection with the services EBX supplies to you. You may not use it to build or operate a service that competes with EBX, and you may not circumvent technical limits such as rate limits or quotas, or attempt to access data belonging to another customer.
We may change the API, including its interfaces and limits, as the service develops. Where a change requires you to act, we give reasonable notice in the manner agreed in your agreement with EBX.
4. Acceptable use
You may not:
access or attempt to access any part of the Services, or any data, that you are not authorised to access
interfere with the operation, integrity or availability of the Services, including by introducing malicious code, or by placing disproportionate load on them
probe, scan or test the Services or their infrastructure for vulnerabilities without our prior written consent
use automated means to extract content from the Services, other than through the API within the limits that apply to you
use the Services in breach of applicable law, or to infringe the rights of others
Reports of security vulnerabilities are welcome at terms@ebx.energy.
5. Content and rights
The Services and their content (text, graphics, software, documentation, designs, logos and trade marks) belong to EBX or its licensors and are protected by intellectual property law. Any use beyond what these Terms and your agreement with EBX allow requires our prior written consent.
Documentation published at docs.ebx.energy may be used by customers and partners as needed to use EBX's services, including internally within their organisation.
6. Availability
We aim to keep the Services available but do not warrant uninterrupted availability. Access may be restricted for maintenance, security or technical reasons. Availability commitments, where agreed, are set out in your agreement with EBX.
Content in the documentation is provided for the purpose of using the Services. It does not constitute advice, a warranty of particular characteristics, or an assurance of any result in energy markets.
Where the Services link to third-party websites, we have no control over their content and accept no responsibility for it.
7. Liability
EBX is liable without limitation for damage arising from injury to life, body or health, for damage caused intentionally or by gross negligence, and under the German Product Liability Act.
In cases of slight negligence, EBX is liable only for breach of an obligation whose fulfilment is essential to the proper performance of these Terms and on whose observance you may reasonably rely, and in that case only for foreseeable damage typical of this type of contract.
Any further liability is excluded.
8. Changes to these Terms
We may amend these Terms where necessary, in particular to reflect changes to the Services or to legal requirements. The current version applies, and the date at the top of this page shows when it was last changed. Continued use of the Services after a change constitutes acceptance of the amended Terms.
9. Governing law and jurisdiction
These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Munich, Germany.
